LTB L1: Application to Evict a Tenant for Non-payment of Rent and to Collect Rent the Tenant Owes

What the L1 is

The L1 is the most common LTB application. It follows an expired N4: if the tenant neither paid in full nor moved out by the N4’s termination date, the landlord may file the L1 the very next day. One application does two jobs — it asks the Board to end the tenancy and evict, and to order payment of the arrears (plus the filing fee, and rent that comes due while the case is pending).

At the hearing the Board may issue a standard eviction order (which the tenant can still void by paying everything owed before it’s enforced), approve a payment plan, or dismiss the application if the N4 or the arithmetic was defective. Only the Court Enforcement Office (sheriff) can physically enforce an eviction order.

How to fill it out

1. File online through the Tribunals Ontario Portal — it is faster than paper and tracks the file for you.
2. Match the N4 exactly: tenant names, address, and arrears must line up with the notice. Discrepancies between the N4 and L1 are the classic fatal defect.
3. Update the rent ledger: the L1 lets you claim rent that has come due since the N4 was served — bring an itemized, period-by-period ledger.
4. Attach the N4 and Certificate of Service.
5. Pay the filing fee (recoverable in the order if you win).
6. Before the hearing, complete the L1/L9 Information Update form showing payments received to date, and be ready to prove service of everything.
