LTB L2: Application to End a Tenancy and Evict a Tenant

The follow-up application when a served notice (N5, N7, N8, N12, N13 and others) expires and the tenant has not moved out.

What the L2 is


The L2 is the general eviction application for grounds other than simple non-payment. It follows notices like the N5 (interference/damage), N7 (serious problems), N8 (end of term), N12 (landlord’s own use) and N13 (demolition/renovation). Some grounds have filing deadlines — for example, an application based on an N5 or N7 must be filed within 30 days of the termination date in the notice (N12/N13-based applications are exempt from that 30-day rule).

At the hearing the landlord must prove the facts in the underlying notice with real evidence — witnesses, photos, ledgers, police reports, sworn declarations for an N12. The Board can also consider whether eviction should be delayed or refused under its relief-from-eviction powers.

How to fill it out


  1. Identify the notice(s) the application is based on and attach each notice with its Certificate of Service.
  2. File in time — diarize the 30-day window for N5/N7/N8-based applications.
  3. Set out the details: the L2 asks what happened and what order you want; keep it consistent with the notice. New incidents since the notice can be included where the form allows.
  4. For N12 applications, include the required declaration/affidavit from the person moving in, and proof the one-month compensation was paid.
  5. Pay the fee, serve what the LTB directs, and prepare evidence — L2 hearings are contested more often than L1s, and details win them.
