LTB T5: Landlord Gave a Notice of Termination in Bad Faith

If you moved out on an N12/N13 and the unit was re-rented or re-listed instead, this application can recover serious compensation.

What the T5 is


The T5 is the remedy for bad-faith evictions. If a tenant moved out because of an N12 (landlord’s own use) or N13 (demolition/renovation) and the stated plan never happened — the unit was re-rented, re-listed at higher rent, left as a short-term rental, or the “family member” never moved in — the former tenant can apply.

The RTA builds in a presumption of bad faith in some situations (for example, re-renting within 12 months of the tenant moving out). Compensation can include the difference between the old and new rent for up to a year, moving and storage costs, general compensation up to statutory caps, and administrative fines. The application must be filed within one year of vacating.

How to fill it out


  1. Identify the notice you moved out under (N12 or N13) and the date you vacated — the one-year clock runs from that date.
  2. Gather the proof of what actually happened: rental listings (screenshot with dates), the unit advertised on MLS or Airbnb, a new tenant’s presence, permits never pulled. Dated screenshots are gold.
  3. Quantify your losses: your old rent vs. your new rent (12-month differential), moving truck and storage receipts, utility hook-ups.
  4. File the T5 with the schedule of losses and pay the fee.
  5. At the hearing the onus shifts in your favour where the presumption applies — but bring the paper trail anyway. Awards on strong T5s are among the largest the Board makes.
