LTB T6: Tenant Application about Maintenance
When the landlord won't repair or maintain the unit — the Board can order repairs, rent abatement, and compensation.
What the T6 is
The T6 enforces the landlord’s duty to keep the unit and building in a good state of repair, fit for habitation, and compliant with health, safety and property standards — a duty that applies even if the tenant knew about the problems when they moved in.
Typical T6 subjects: mould, pests, broken heating, leaks, unsafe electrical, non-functioning appliances the landlord provides. Remedies include orders to do the repairs (with deadlines), rent abatement for the affected period, reimbursement of the tenant’s out-of-pocket costs, and authorization for the tenant to do the work and deduct the cost. Events more than one year before filing generally fall outside the claim.
How to fill it out
- List each maintenance issue separately with when it started and when you told the landlord. Written notice (text/email) beats “I mentioned it in the hallway.”
- Document relentlessly: dated photos and videos, municipal property-standards inspection orders, exterminator reports, hydro bills showing space-heater use.
- Quantify the remedy per issue: e.g., 25% abatement for four months without reliable heat; receipts for a dehumidifier. The Board thinks in percentages and periods.
- File, pay the fee (or request a waiver), and keep paying rent while the application is pending.
- If conditions are dangerous, also call municipal property standards or public health — their orders are powerful corroboration at the hearing.
